Flood Asbestos Removal
Information for property owners and asbestos contractors who need to remove asbestos-containing materials from property in disaster-declared flood areas of New York State:The Asbestos Control Bureau oversees the abatement of toxic hazards associated with asbestos fiber during the rehabilitation, reconstruction or demolition of buildings and other structures originally constructed with asbestos or asbestos-containing materials. The Bureau enforces the New York State Labor Law and Industrial Code Rule 56 (Asbestos). Requirements of this code include the licensing of contractors, certification of all persons working on asbestos projects, filing of notifications of large asbestos projects and pre-demolition survey of buildings to identify any asbestos, which may be present, to ensure proper abatement of asbestos materials. The Bureau works closely with the Environmental Protection Agency (EPA).
Asbestos-containing materials can be removed from an owner-occupied single family residence in the following manner:
1. The homeowner can choose to remove the asbestos themselves, which exempts them from following the provisions of Code Rule 56 and from paying any project notification fees to the Department. (EPS Asbestos in Your Home Fact Sheet). It is not recommended and should only be performed by highly trained, experienced, certified individuals, and licensed contractors.
Or
2. The homeowner can hire a licensed asbestos contractor who will be required to abate the asbestos in accordance with Code Rule 56. The following link provides a listing of Department-licensed asbestos contractors.

If a licensed contractor needs to file an Emergency Project Notification, they must first call the Program Manager's office of the Asbestos Control Bureau at 518-485-9263 for prior approval of emergency status. If approved, you will be given an emergency request reference number. Have the reference number available, then click on "Complete Emergency Notification" on the next page to complete the notification.
