Text Box: NOTIFICATION OF REQUIREMENT TO PARTICIPATE IN THE SURVEY OF OCCUPATIONAL INJURIES AND ILLNESS CALENDAR YEAR 2009

Some employers within New York State recently received the US Department of Labor, Bureau of Labor Statistics’ “Notification of Requirement to Participate in the Survey of Occupational Injuries and Illnesses – Calendar Year 2009”. Those employers who received this notice will actually be surveyed in 2010 to provide data from calendar year 2009. The standard notice letter in the packet only mentions the OSHA recordkeeping regulations and forms, and does not include references to PESH injury and illness recordkeeping requirements or PESH forms. This has caused some confusion among the public employers who have received the survey notice packet.

Although the OSHA injury and illness recordkeeping forms are not the same in appearance and in the regulations they reference, Public employers in New York State who collect and record information according to PESH requirements will not have any additional burdens in completing the survey. The data requested in the survey can be obtained using the PESH SH 900 Injury and Illness Log and the SH 900.2 Injury and Illness Incident Report or the Workers Compensation (C2) forms.

Public employers with questions or concerns regarding this survey should call the Division of Research and Statistics at (212) 775-3344.

The current public employer PESH injury and illness recordkeeping forms are found at the New York State Department of Labor website at: http://www.labor.state.ny.us/workerprotection/safetyhealth/DOSH_PESH.shtm
